Terms of Use for the TUM Jobportal

(1) Introduction
In accordance with Art. 2 (5) sentence 2 of the Bavarian Higher Education Act, the Technical University of Munich promotes the acquisition of additional qualifications in cooperation with industry and the employment services in order to facilitate the transition to professional life for the members of its university. Among other things, it offers an online job and internship exchange designed to make it easier for students, graduates, doctoral candidates, alumni, and all TUM members to find jobs and thus start their careers and further their professional development.
(2) Operator, users, and customers
These Terms of Use apply between the operator of the “TUM Job Portal,” the Technical University of Munich (hereinafter referred to as the “Operator”), and the users (hereinafter referred to as Users) who use this online job portal to search for job offers or find out about career events and services, as well as between the Operator and Customers.
Customers are defined below as companies, organizations, or institutions that use and/or book a service provided by the TUM Job Portal. Customers can use and/or book various services via the TUM Job Portal, in particular advertising job vacancies and event information, posting company profiles, or subscribing to the newsletter for companies. In addition to the Terms of Use, the Privacy Policy and the General Terms and Conditions apply to customers.
(3) Subject matter of the contract
The TUM Job Portal is a university-owned online job portal operated by the operator at the URL www.tum.de/jobs, which is free of charge for users. Users can search for job vacancies and find out about career events and services via the portal. No registration is required for users.
Customers must register and, once registered, can use the portal to publish their job vacancies and career events, book other services for companies and institutions, and subscribe to the newsletter for companies. Individual services are subject to a fee for customers.
The operator merely provides the platform for publishing these job advertisements and event notices. Users apply directly to the advertising customers without the involvement of the operator.
(4) Copyrights
The TUM Job Portal contains data and information that are protected by trademark and/or copyright laws. Therefore, it is not permitted to download, reproduce, or distribute websites of the TUM Job Portal or parts thereof. Without the operator's consent, it is not permitted to refer to the TUM Job Portal by means of links, hyperlinks, or framed links; the only exceptions to this latter rule are other institutions or departments of the Technical University of Munich.
(5) Liability and warranty
(5.1.) The operator, its legal representatives, and vicarious agents shall be liable to users for breach of material contractual obligations, i.e., obligations that enable the proper execution of the user agreements in the first place and on whose compliance users may regularly rely, for intent and any negligence, but in cases of simple negligence limited to foreseeable damage typical for this type of contract.
(5.2.) Otherwise, the operator, its legal representatives, and vicarious agents shall only be liable for damages caused by intent or gross negligence. In the event of gross negligence, liability shall be limited to the foreseeable damage typical for this type of contract.
(5.3.) The operator's liability pursuant to (5.2.) for indirect damage and consequential damage is excluded in the event of gross negligence.
(5.4.) The above limitations and exclusions of liability (5.1. – 5.3.) do not apply in the event of injury to life, limb, or health, or in the event of claims under the Product Liability Act.
(5.5.) The operator accepts no responsibility for the content of job advertisements, company profiles, and event notices published by the operator on behalf of customers, in particular for their topicality, accuracy, completeness, quality, or the content of texts, PDFs, addresses, links, or other information provided by the customer. The customers are solely responsible for the content of job advertisements, company profiles, and event notices.
(5.6.) The operator accepts no responsibility if users pass on data to customers.
(5.7.) The operator will immediately investigate any reports of potentially illegal content or violations of third-party rights and, after reviewing the content, will initially block it temporarily to protect users and, if the content is found to be inadmissible, block it permanently.
(6) Downloads and links
Downloads are at your own risk. The operator accepts no liability for damage caused by downloading, installing, using, or storing content from the TUM Job Portal.
The operator has no control over websites that link from the TUM Job Portal to external websites. If users follow links to other websites and thereby leave the TUM Job Portal website, they do so at their own risk. The operator accepts no responsibility or liability for the content of linked websites.
If the operator becomes aware of illegal content on linked websites, it will initially block the corresponding links temporarily and, after appropriate review and confirmation of the illegality of the content, permanently block the links.
Users are advised that the terms of use and privacy policies of linked websites may differ from the terms of use and privacy policies of the TUM Job Portal and must be observed.
(7) Customer content
Users are advised that they are responsible for the disclosure of personal data to customers and should exercise care and caution. Users should verify the identity of the recipients of their personal data. Caution is advised when disclosing data to private email addresses. It is strongly advised not to disclose sensitive data such as ID card numbers, credit card numbers, or bank details. Users should also bear in mind that customers may use personal data for purposes other than those specified in the job advertisement.
(8) Changes to the Terms of Use
The content and functions of the TUM Job Portal are constantly being developed and improved. Accordingly, these Terms of Use are constantly being adapted and updated. (9) Miscellaneous
(9.1.) There are no verbal side agreements. The legal invalidity of individual parts and provisions of these Terms of Use does not affect their validity in other respects.
(9.2.) The law of the Federal Republic of Germany applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Munich.
(9.3.) The German version of the Terms of Use is the legally binding version.
